Independence of the judges as essential part of independence of the judicial power

Analyzing the present-day state of the institution of independence of the judiciary and by-law nature of judges’ activities, it is necessary to note, that there is no unity in opinions on the notion of independence of the judiciary. Taking into account different opinions on the question, we came to the conclusion, that independence of the judiciary is formed by the influence both of objective (promoting its manifestation) and subjective (subject’s volitional orientation) factors, which operating jointly should provide:
